This Privacy Policy applies to data collected by Logic9s, LLC and its subsidiaries (“Logic9s,” “we” or “us”) through the use of the ClearFactrTM service we offer (the “Service”) and through the use of the website,, and other related webpages (each a “ClearFactr Site”). By using a ClearFactr Site and/or providing data or other information via a ClearFactr Site or through your use of the Service, you are indicating your consent to this Privacy Policy and agree to be bound by its terms.

This Privacy Policy addresses how we collect, use and handle certain information, including the following three general categories of information, as described in more detail in this Privacy Policy below:

  • “Personal Information” (generally, information that identifies a particular user).
  • “Usage Statistics” (generally, statistics regarding how our Service is used, such as which features are used most frequently).
  • “Customer Data” (generally, data submitted by users to be processed by our Service).

The three most important things you need to know are:

  1. We are committed to protecting the privacy of your Customer Data and Personal Information.

Personal Information

You can visit a ClearFactr Site without telling us who you are and without revealing any information about yourself. There are times, however, when we may need certain personally identifiable information (“Personal Information”) from you.

If you contact us through a ClearFactr Site, for example to ask questions about our Service or to request more information, we will ask you to provide certain Personal Information (such as your name, address, email address, phone number, company name and your title). You will also be required to provide Personal Information when you sign up to use our Service. When you provide Personal Information we will use that Personal Information to provide you with the information you request or to provide you with access to our Service. We may also use the Personal Information to help us understand who is interested in our Service, who is using our Service, to communicate with you regarding your account, and to help us manage and improve the ClearFactr Site and our Service. If you wish to subscribe to a newsletter we may publish from time to time, we will use your name and email address to send the newsletter to you. If you no longer wish to receive our newsletter, you may unsubscribe as provided in the “Choice/Opt-out” section of this Privacy Policy.

Usage Statistics

We may also collect anonymous information from visits to a ClearFactr Site to help us provide better customer service and to make a ClearFactr Site as user friendly as possible. For example, we may keep track of the domains from which people visit the ClearFactr Site and measure visitor activity on a ClearFactr Site, to analyze trends and statistics. We may also monitor your use of our Service and use data related to your use in an aggregated manner, including to compile statistical and performance information related to the provision and operation of our Service. However, when we collect the information described in this paragraph, we do so in ways that keep the information anonymous. We may disclose the anonymous statistical information we collect to others, provided that the information does not identify you or reveal your information that we have agreed to treat as confidential. This anonymous statistical information does not include your User Data (which we will not review, share, distribute, or reference except as provided in our Terms of Service, or as may be required by law).


A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on all ClearFactr Sites – they are required to make our software run. We do not add the information we store in cookies to any personally identifiable information you submit while on a ClearFactr Site. We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate a ClearFactr Site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file. We may use persistent cookies to make it more convenient for you to use our Service. For example, we may use persistent cookies to store a unique cryptographic hash value so you don’t have to enter your username more than once on a given computer. The information stored does not contain any personally identifiable information.

IP Addresses

When you visit a ClearFactr Site, we collect your Internet Protocol (“IP”) addresses to track and aggregate non-personal information. For example, we use IP addresses to monitor the regions from which customers and visitors navigate a ClearFactr Site. We may also collect IP addresses from customers when they log in to use our service as part of our security features.

Usage Analytics

We may employ third-party usage analytics software (such as Google Analytics) to monitor our customers’ use of our Service and the ClearFactr Site, in order to help us improve our Service and to better manage content on the ClearFactr Site by informing us what content is most frequently used and most effective. We do not tie the information collected through usage analytics software to our customers’ personally identifiable information. We will use the information collected through usage analytics software only internally, to improve our Service and to market our Service to you, and we will not disclose that information to others in a form that may identify any individual customer.

Links to Other Web Sites

A ClearFactr Site may contain links to other web sites. Logic9s is not responsible for the privacy practices or the content of such web sites. The links from a ClearFactr Site do not imply that Logic9s endorses or has reviewed the third party web sites. We suggest contacting the operators of those web sites directly for information regarding their privacy policies.

Plan Sharing

If, through our Service, you choose to share with others the plans you create using our Service, we may ask you for certain information concerning the other user such as a name and email address. We may send the other user an invitation to visit a ClearFactr Site or to subscribe to our Service. We would store that information for the sole purpose of sending those communications and tracking our marketing efforts. Invited users may request that we remove this information from our database through the procedure described in the “Choice/Opt-out” section of this Privacy Policy. A user with whom you choose to share your plans must agree to certain terms and conditions in order to gain and maintain access to your plans.

Blogs/Forums/Chat Rooms/Bulletin Boards

If you use a blog, forum, chat room or bulletin board on a ClearFactr Site (“Forum(s)”), you should be aware that any personally identifiable information you submit in a Forum can be read, collected, or used by other users of such Forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in a Forum.


We will not identify you as a customer of Logic9s on a ClearFactr Site or in other public communications unless you “opt in” to permit us to do that.

Our Disclosure of Your Personal Information and Other Information

Logic9s is not in the business of interpreting, deciphering, studying or selling your Personal Information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Information with certain third parties without further notice to you, as set forth below:

  • Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a sale of our assets, merger, reorganization, dissolution or similar event, Personal Information may be part of the transferred assets.
  • Related Companies: We may also share your Personal Information with any of our subsidiaries, affiliates and other related companies that may exist from time to time, for purposes consistent with this Privacy Policy.
  • Credit Card Processing: If we use a third-party service provider to manage credit card processing for payments you submit, we may we may share your Personal Information with that third party service provider. Any such service provider is not permitted to store, retain, or use billing information except for the purpose of credit card processing on our behalf.
  • Agents, Consultants and Related Third Parties: Logic9s, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases and processing payments. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.
  • Legal Requirements: Logic9s may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of Logic9s, (iii) act in urgent circumstances to protect the personal safety of users of a ClearFactr Site or the public, or (iv) protect against legal liability.

Joint Offerings

We might from time to time partner with other companies to jointly offer products or services. If we do that, we may ask whether you would like to “opt in” to receive information about a jointly-offered product or service. We will share your information with our business partner only if you do opt in. In that event, however, use of the information by our business partner will be in accordance with that partner’s own privacy policy, which we do not control.

International Transfer of Information Collected

To facilitate our global operations, we may transfer and access information regarding visitors to the ClearFactr Sites from around the world, including the United States. This Privacy Policy shall apply even if we transfer that information to other countries.

Customer Data

Logic9s customers may electronically submit data or information to the Logic9s Service for hosting and processing purposes (“Customer Data”). We will not review, share, distribute, or reference any such Customer Data except as provided in our Terms of Service, or as may be required by law. We may access Customer Data only for the purpose of providing our Service, preventing or addressing Service or technical problems, at a Logic9s customer’s request in connection with customer support matters, or as may be required by law.


Personal ˜nformation collected through a ClearFactr Site is kept in a secure database and all commercially reasonable precautions are taken to secure this data. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from a ClearFactr Site may not be secure. Therefore, you should take special care in deciding what information you send to Logic9s via e-mail. Please keep this in mind when disclosing any Personal Information to Logic9s via the Internet. The security of your Personal Information is important to us. When we transmit sensitive information you enter on the ClearFactr Site, we encrypt that information using secure socket layer technology (SSL).


If you no longer wish to receive emails, newsletters or other communications from us, you may unsubscribe at any time by changing your account settings, by using the unsubscribe link located at the bottom of such communication, or by email at

Exceptions for Individual Customers

If we want to create exceptions to this Privacy Policy that apply to individual customers, we will ask those customers to specifically “opt in” for those exceptions. Any exceptions to this Privacy Policy will apply only to those customers who “opt in” and agree to the exceptions.

Changes to Our Policy

We may change our business and a ClearFactr Site from time to time. As a result, at times it may be necessary for us to make changes to this Privacy Policy. We reserve the right to update or modify this Privacy Policy at any time and from time to time without prior notice. If we do make material changes to this Privacy Policy, we will notify you by posting the modified Privacy Policy on the ClearFactr Site, by email, and/or by means of a notice on our home page. Please review this Privacy Policy periodically, and especially before you provide Logic9s with any Personal Information. This Privacy Policy was last updated on the date indicated at the top of this Privacy Policy. Your continued use of a ClearFactr Site after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.

Correcting, Updating and Accessing Your Personal Information; Other Questions

You will have the right to contact us to request information about the Personal Information we have collected from you and to request the correction, modification or deletion of any of that Personal Information.
